1. Identification of the Provider

These Terms and Conditions govern the access, navigation, and use of this website, as well as the engagement of professional digital services, including but not limited to:

• E-commerce website development (infrastructure only; no sales management)

• Performance and mobile optimization

• Basic Search Engine Optimization (SEO) setup

• Ongoing optimization and technical maintenance services

 

The Provider reserves the right to evaluate and accept projects at its sole discretion, based on internal standards and technical capabilities.

3. Scope of Services

 

The specific scope of each project will be defined in a formal proposal (the “Proposal”), which will include:

• Deliverables

• Inclusions and exclusions

• Pricing

• Timeline

 

Any work not explicitly stated in the Proposal shall be considered out of scope and subject to additional fees.

 

Services do not include third-party subscriptions, hosting, domain registration, or external licenses unless explicitly stated.

4. Engagement Process

 

The service process includes:

1. Initial project or business analysis

2. Proposal preparation and presentation

3. Client approval

4. Required upfront payment

 

To commence any project, the following are required:

• A non-refundable 50% deposit, unless full payment is specified in the Proposal

• Timely delivery of all required content by the client (text, images, media, etc.)

 

If content is not provided, the Provider may use generic assets from royalty-free libraries or AI-generated content.

 

The client retains final approval over design decisions, provided they remain within the agreed scope.

5. Payment Terms

• A non-refundable deposit of 50% is required to begin the project, unless otherwise specified

• The remaining balance must be paid within 5 calendar days after project completion

 

The final editable delivery, transfer of access, and full release of the project will only occur once full payment has been received.

 

In case of non-payment:

• The project may be suspended, unpublished, or restricted

• The client will have an additional 7 calendar days to complete payment, subject to a 15% late fee on the total project cost

• Failure to pay within this period will result in permanent project termination without recovery rights

 

No refunds will be issued under any circumstances.

 

Installment payment options (if available) are subject to current promotions and may change without notice.

6. Project Pauses

 

The client may request a project pause under the following conditions:

• Minimum 7 calendar days’ notice

• Maximum pause period of 14 calendar days at no additional cost

 

For extended pauses:

• A fee of 10% of the total project value will apply, covering up to 28 additional calendar days

 

After this period, the project will automatically resume.

 

A lack of client response, feedback, or material delivery for 7 consecutive calendar days will be considered an automatic project pause, subject to the same conditions.

7. Cancellation and Termination

 

The client may cancel the project at any time; however, no refunds will be provided.

 

The Provider reserves the right to terminate the project if:

• These Terms are breached

• The client fails to collaborate

• Delays are caused by the client

 

Any work produced may be reused or discarded at the Provider’s discretion.

8. Intellectual Property

 

The Provider retains full ownership of all intellectual property rights related to designs, structures, code, and developed elements.

 

The client is granted a non-exclusive license to use the final product upon full payment.

 

Client-provided content remains the property of the client.

 

The Provider reserves the right to:

• Showcase completed work in its portfolio

• Reuse non-client-specific components in other projects

 

The client may not resell, claim authorship of, or redistribute the work as their own.

9. Results Disclaimer

 

The Provider does not guarantee specific results regarding:

• Website traffic

• Search engine rankings

• Conversions or sales

 

These depend on external variables such as market conditions, competition, and platform algorithms.

 

Only the technical execution of the service is guaranteed.

10. Limitation of Liability

 

The Provider shall not be liable for:

• Direct or indirect damages

• Financial losses

• Loss of profits

• Service interruptions caused by third parties

 

Once the project is delivered, the client assumes full responsibility for its use and compliance with third-party platform policies.

11. Third-Party Tools and Services

 

Projects may involve third-party platforms such as hosting providers, domain registrars, analytics tools, or other digital services.

 

The Provider is not responsible for:

• Technical failures

• Policy changes

• Service interruptions

 

Support related to third-party tools may be provided at an additional cost.

12. Support and Maintenance

 

A 5-business-day support period is included after delivery, limited to:

• Fixing pre-existing issues

• Basic usage guidance

 

This support does not include:

• Modifications or redesigns

• Ongoing maintenance

• Issues caused by client intervention

 

Maintenance services must be contracted separately.

13. Revisions

 

Each project includes the number of revisions specified in the Proposal.

 

If not specified, the project includes one (1) revision round.

 

Additional revisions or major changes will incur extra charges.

14. Acceptable Use
